1. Introduction

DanceUP ("the Company," "we," "us," or "our") is operated by CodeBlack Technologies LLC. This Privacy Policy governs the access to and use of the DanceUP platform, including the website (danceup.app), the DanceUP Studio dashboard, and all related services (collectively, the "Service"). By accessing or using the Service, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy.

2. Information We Collect

We collect information that you provide directly to us, as well as information generated automatically during your use of the Service.

2.1. Account and Profile Information

  • Dancers: Name, email address, password, location data, and dance preferences.
  • Studio Owners/Organizers: Name, email address, studio name, physical location, class descriptions, pricing, availability, and professional credentials.

2.2. Payment and Financial Data

All financial transactions are processed by our third-party payment processor, Stripe, Inc.

  • Subscription Billing: We collect billing details for DanceUP Studio subscriptions. We do not store full credit card numbers on our servers.
  • Stripe Connect: We collect information required to facilitate payouts to studios and organizers. Use of these services is subject to the Stripe Connected Account Agreement.

2.3. Student and Attendee Data

Studio owners may upload or collect information regarding their students, including names, contact information, attendance records, and credit balances.

2.4. Automatically Collected Data (Usage & Cookies)

We use cookies, log files, and similar tracking technologies to collect:

  • Usage Details: Dashboard activity, feature engagement, and timestamps.
  • Device Information: IP address, browser type, operating system, and device identifiers.
  • Cookies: Essential cookies for authentication and functional cookies to remember your preferences. You may manage cookie settings through your browser, though some features may become unavailable.

3. Cookies & Tracking

We use cookies and similar technologies primarily to ensure the Service functions properly and to support authentication and security.

  • Firebase Authentication Cookies: Our authentication and session management (provided through Google Firebase) may use cookies or similar identifiers to keep you signed in and to protect your account.
  • Functional Cookies: We use functional cookies to remember preferences and support core features of the Service (for example, keeping your session active).

You can manage cookies through your browser settings; however, disabling cookies may prevent certain features from working.

4. How We Use Your Information

We process your information for the following business purposes:

  • To facilitate class discovery and centralized booking.
  • To manage and maintain studio accounts and dashboards.
  • To process payments and facilitate payouts.
  • To send administrative notifications, billing receipts, and support responses.
  • To analyze Service performance and develop new features for the dance community.
  • To enforce our Terms of Service and comply with legal obligations.

5. Third-Party Services and Data Sharing

We do not sell your personal data. We share information only with trusted service providers who assist in operating our platform:

  • Infrastructure: Google Firebase and Google Cloud (Data storage, authentication, and hosting).
  • AI Services: Google's Gemini API (used to generate content suggestions, such as descriptions and messages, from information you provide).
  • Payments: Stripe, Inc. (Payment processing and financial services).
  • Legal Requirements: We may disclose information if required by law or in response to valid requests by public authorities.

6. Roles: Data Controller vs. Data Processor

  • Studio Owners: In relation to student data managed within the platform, the Studio Owner is the Data Controller. You are responsible for obtaining the necessary consents from your students to process their data.
  • DanceUP: We act as the Data Processor regarding student data, handling such information only as directed by the Studio Owner through the use of the platform.

7. Security

We implement robust technical and organizational security measures designed to protect your data from unauthorized access, loss, or alteration. Our practices include:

  • Encryption in Transit (SSL/TLS): We use SSL/TLS to encrypt data transmitted between your device and our Services.
  • Access Controls: We limit internal access to personal information to authorized personnel and contractors who need it to operate, develop, or support the Service.
  • Security Practices: We use reputable cloud providers (including Google Firebase/Google Cloud) and payment processors (Stripe), maintain logging and monitoring where appropriate, and apply updates and patches intended to reduce security risks.

However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

8. International Transfers

DanceUP is based in the United States. Information collected through the Service may be transferred to, stored in, and processed in the United States or any other country in which CodeBlack Technologies LLC or its service providers maintain facilities (including Google Cloud and Stripe, which may process data in the U.S.).

If you are located outside the United States, you understand that your information may be transferred to the U.S., which may have different data protection rules than those in your jurisdiction. Where required (including for GDPR and applicable U.S. state privacy laws such as CCPA/CPRA), we take steps intended to provide an appropriate level of protection for such transfers.

9. Data Retention and Account Deletion

We retain data for as long as your account is active or as needed to provide the Service.

  • 90-Day Pending Window: Upon a request for account deletion, the account enters a 90-day "Pending Deletion" period. During this time, the request may be cancelled via the Billing & Account settings.
  • Permanent Deletion: After 90 days, all personal profiles, studio content, and student records are permanently purged from our active databases.
  • Financial Records: Transactional data is anonymized and retained for seven (7) years to comply with tax and regulatory requirements.

10. Your Rights and Choices

Depending on your location, you may have the following rights:

  • Access & Export: You may download a copy of your studio data at any time via the dashboard.
  • Correction: You may update inaccurate profile information through your account settings.
  • Marketing Opt-Out: If you subscribe to newsletters, product updates, or dance tips, you can opt out at any time by using the "unsubscribe" link in those emails (or by contacting us at the email address below).
  • Service-Related Emails: Even if you opt out of marketing, we will still send essential non-marketing communications related to your account and use of the Service (for example: security alerts, billing receipts, changes to our Terms/Policies, and support messages).
  • Deletion: You may initiate account deletion at any time.

11. Children's Privacy

The Service is intended for users aged 18 and older. If a studio owner manages data for minors, the studio owner is solely responsible for obtaining verified parental consent. If we learn we have collected personal information from a child under 13 without parental consent, we will delete that information immediately.

12. Changes to This Policy

We reserve the right to modify this Privacy Policy at any time. Changes will be signaled by updating the "Last Updated" date. For material changes, we will provide notice via email or an in-app notification. Your continued use of the Service following such updates constitutes acceptance of the revised policy.
