1. Acceptance of Terms
By accessing or using DanceUP Studio (the "Service"), operated by THELDC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all studio owners, instructors, and other users who access the DanceUP Studio platform.
2. Description of Service
DanceUP Studio is a platform designed for dance studio owners and instructors to manage their business. The Service provides tools to:
- Create and manage class, workshop, and event listings.
- Manage student enrollment, attendance, and credit balances.
- Create and sell class credit packages (one-time and subscription-based).
- Process student payments and charge saved cards on file.
- View analytics including attendance, revenue, and reviews.
- Communicate with students via marketing campaigns.
3. Account Registration and Eligibility
To use DanceUP Studio, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Keep your password confidential and accept responsibility for all activity under your account.
- Be at least 18 years of age to create an account.
- Represent a legitimately operating dance studio, fitness studio, or teaching business.
4. Subscription and Billing
Access to DanceUP Studio features is provided through a paid subscription. All billing is handled by Stripe, Inc.
- Subscriptions automatically renew on the billing cycle stated at sign-up unless you cancel before the renewal date.
- Cancellations take effect at the end of the current billing period; you retain access until then.
- Refunds are not provided for partial billing periods, except where required by applicable law.
- Pricing changes will be communicated with reasonable advance notice prior to your next renewal.
5. Stripe Connect and Payments
DanceUP Studio integrates with Stripe Connect to facilitate payment processing for your students. By using payment features, you agree to Stripe's Connected Account Agreement. You are responsible for:
- Maintaining an active and compliant Stripe Connect account where applicable.
- Ensuring accurate pricing on all packages and offerings.
- Handling any chargebacks, refunds, or disputes from your students directly.
- Obtaining appropriate consent from students before charging their saved payment methods.
6. Studio Owner Responsibilities
As a studio owner using the Service, you agree to:
- Post accurate and up-to-date information about your classes, schedules, pricing, and availability.
- Honor confirmed bookings and package credits issued through the platform.
- Comply with all applicable local, state, and federal laws, including those governing employment, health, safety, and consumer protection.
- Handle your students' personal data responsibly and in compliance with applicable privacy laws.
- Not misuse the platform to engage in fraudulent, deceptive, or harmful practices.
7. Prohibited Conduct
You agree not to:
- Misrepresent your studio, classes, or qualifications.
- Charge students for services not provided or issue fraudulent credits.
- Attempt to gain unauthorized access to any other account, system, or data.
- Use the platform to send unsolicited bulk communications beyond the Service's built-in marketing tools.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service for any unlawful purpose.
THELDC reserves the right to suspend or terminate accounts that violate these Terms without refund.
8. Intellectual Property
The DanceUP name, logo, platform design, and all content created by THELDC are the intellectual property of THELDC. You may not reproduce, distribute, or create derivative works without our express written permission. Content you create within the platform (class descriptions, studio photos, etc.) remains your property; by submitting it, you grant THELDC a limited license to display it within the Service.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. THELDC does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, THELDC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. THELDC's total liability for any claim shall not exceed the total subscription fees you paid to us in the twelve months preceding the claim.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
12. Changes to These Terms
THELDC may update these Terms at any time. We will notify you of material changes by email or via an in-app notice and will revise the "Last updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
13. Account Deletion and Data Export
You may request deletion of your account at any time from the Billing & Account section in the DanceUP Studio dashboard or app. Account deletion works as follows:
- 90-day pending window: When you submit a deletion request, your account enters a 90-day pending deletion period. Your account remains accessible during this time and you may cancel the request at any point from the Billing & Account settings.
- Cancellation: To cancel a pending deletion, visit Billing & Account settings and select "Cancel Deletion Request" at any time before the 90-day window expires.
- Permanent deletion: After the 90-day window, your account profile, studio listings, class and event data, student records, and all personally identifiable information are permanently deleted and cannot be recovered.
- Financial records: Transaction and billing records (amounts, dates) are anonymized and retained for 7 years as required by applicable tax and financial regulations. All personally identifiable information is removed from these records.
- Subscription: Any active subscription is cancelled at the end of the current billing period when a deletion request is submitted. No refund is provided for any remaining subscription period unless required by law.
- Data export: You may download a complete copy of your studio data at any time from the Billing & Account page before deletion. We recommend exporting before your 90-day window expires.
By requesting account deletion, you acknowledge these terms. THELDC is not liable for data loss following permanent deletion or for studio credits forfeited by your students as a result of your account deletion.
